Terms of Service
These terms have two parts. **Part A** is the contract under which we sell goods to you. **Part B** governs your use of the website. If the two ever conflict on a matter of sale, Part A prevails.

1. Who we are
These terms apply to every sale of goods made through bramwellviews.co.uk.
The seller is AKYT LTD, a company registered in England and Wales under company number 17022802, whose registered office is at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom. AKYT LTD trades as Bramwell Views. In these terms, "we", "us" and "our" mean AKYT LTD, and "you" means the person buying goods from us.

2. These terms
These are the terms on which we sell goods to you. Please read them before you place an order. By placing an order you confirm that you accept them.
We may change these terms from time to time. The version that applies to your order is the version published on this website at the moment you place it. We will keep a copy of your order, but we do not file these terms separately for you, so please save or print a copy.
We sell only to consumers buying for personal use, and only to people aged 18 or over. We do not sell to businesses through this website, and we may decline orders that appear to be for resale.
3. The goods
We sell binoculars and related optical accessories, principally 10x42 roof prism binoculars with an integrated laser rangefinder.
The specifications and images shown on each product page describe the goods as accurately as we can. Images are illustrative: colours vary between screens, and a photograph cannot show exact proportions.
Optical specifications matter on these products. Magnification, objective diameter, field of view, exit pupil and eye relief are published on each product page. If you are unsure which configuration suits how you intend to use the instrument, ask us before you order and we will answer within 24 to 48 hours. Choosing a specification that does not suit you is not a fault in the goods, and is handled as a change-of-mind return under our Returns and Refunds Policy.
4. How the contract is formed
Placing an order is an offer to buy. It is not accepted until we send you a dispatch confirmation email. The contract between us comes into existence at that moment.
If we cannot accept your order — because the item is out of stock, because we have identified a pricing or description error, or because we cannot deliver to your address — we will tell you and will not charge you. If you have already paid, we will refund you in full.
Before you confirm your order you can review it and correct any input errors. Please check the delivery address carefully.
5. Price and payment
Prices are shown in pounds sterling on the product page and are the total price of the goods. Delivery costs, where any apply, are shown separately before you complete checkout, and the total payable is confirmed on the checkout page before you pay.
Prices can change, but a change will never affect an order we have already accepted.
We take payment when you place your order. We accept debit and credit cards, PayPal, Klarna, Apple Pay and Google Pay. Payment options are subject to the provider's own eligibility criteria and terms.
If a price shown is obviously wrong — a manifest error — and you could reasonably have recognised it as an error, we are not obliged to supply at that price. We will contact you before dispatch and you may either confirm at the correct price or cancel for a full refund.
6. Delivery
We deliver to addresses in the United Kingdom. Full details are in our Delivery Policy, which forms part of these terms.
Orders are normally dispatched within 24 to 48 hours, excluding weekends and UK bank holidays. Typical total delivery time is 7 to 10 working days from order. These are estimates, not guaranteed dates, unless we have expressly agreed a fixed date with you. Unless we agree otherwise, we will deliver without undue delay and in any event within 30 days of the contract being formed.
If we miss a delivery deadline that was essential — because you told us so before you ordered, or because it is obvious from the circumstances — you may treat the contract as at an end straight away. Otherwise you may set a new reasonable deadline and end the contract if we miss that too. If you end the contract for late delivery we will refund you in full for goods not delivered.
Risk and ownership. The goods are at our risk until they are delivered to you or to a person you have identified to receive them. Ownership passes to you when we have received payment in full.
Access. These are large, heavy, glass-fronted items. Please make sure the delivery address is reachable by the carrier's vehicle and that there is somewhere to put the goods. If a delivery fails because nobody is available, the address is wrong, or access is unsuitable, the carrier may rearrange it. We will contact you before charging any reasonable additional delivery cost.
7. Your right to change your mind
You have a legal right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and we extend it. Both are set out in full in our Returns and Refunds Policy, which forms part of these terms. In summary:
8. Faulty goods — your legal rights
We are under a legal duty to supply goods that conform to this contract. Nothing in these terms affects your rights under the Consumer Rights Act 2015, which include:
You are also entitled to a repair or replacement for a fault that was present at delivery.
Inspect the outer packaging on delivery. If it is visibly damaged, note this with the driver and photograph it before unpacking. Please report transit damage to us within 48 hours with photographs and we will arrange a replacement at our cost.

9. Our warranty
In addition to your legal rights, we provide a 2-year warranty from the date of delivery covering the goods against defects in materials and workmanship in normal domestic use.
The warranty does not cover damage caused by misuse, incorrect installation, unauthorised repair or modification, accident, or normal wear to consumable parts. It does not limit or replace your rights under the Consumer Rights Act 2015.
10. Use and care
Our instruments require no installation. They are supplied ready to use, sealed and nitrogen purged, and the rangefinder is a Class 1 eye-safe laser under BS EN 60825-1.
You are responsible for using the goods in line with the instructions supplied, including the care of coated optical surfaces and the correct handling and disposal of batteries. We are not liable for loss or damage caused by use outside those instructions, by unauthorised repair or modification, or by any attempt to open the sealed body.
11. Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the goods, and under Part I of the Consumer Protection Act 1987.
We supply goods for domestic and private use. We are not liable for business losses, loss of profit, loss of business or loss of opportunity.
12. Events outside our control
We are not liable for any failure or delay in performing our obligations caused by an event outside our reasonable control. If such an event occurs we will contact you as soon as possible and, where the delay is substantial, you may contact us to end the contract and receive a refund for goods you have paid for but not received.
13. Complaints and disputes
If something has gone wrong, email contact@bramwellviews.co.uk. We acknowledge every complaint within 24 to 48 hours and aim to resolve it within 14 days.
We do not currently subscribe to an alternative dispute resolution scheme. If we cannot resolve your complaint between us, you may take the matter to court.
14. Other important terms
We may transfer our rights and obligations under these terms to another organisation. We will tell you in writing if this happens, and we will make sure the transfer does not affect your rights.
You may only transfer your rights or obligations under these terms to another person if we agree in writing.
This contract is between you and us. No other person has any right to enforce any of its terms.
Each paragraph of these terms operates separately. If a court decides that any of them is unlawful, the remaining paragraphs remain in full force.
If we do not insist that you perform any of your obligations, or if we delay in taking steps against you, that does not mean we have waived our rights.
15. Governing law and jurisdiction
These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you may bring proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you may bring proceedings in either the Northern Irish or the English courts.

Part B — Terms of Website Use
These terms govern your use of bramwellviews.co.uk. By using the site you accept them. The company details, complaints route and governing law in Part A apply equally here.
B1. Using the site
You may use the site for lawful personal purposes. You must not:

B2. Availability
We do not guarantee that the site will always be available or uninterrupted. We may suspend, withdraw or restrict all or part of it for business or operational reasons, and we will give reasonable notice where we can.
You are responsible for arranging your own access to the site, and for making sure everyone who accesses it through your internet connection is aware of these terms.
B3. Accuracy of content
We take care over the content of the site, but it is provided for general information. Product specifications and images are given in good faith and are based on information supplied by our manufacturers. Colours vary between screens.
Where a specification matters to your purchase, please ask us to confirm it rather than working from a product photograph. We reply within 24 to 48 hours.
We may correct errors and update content at any time, including after you have placed an order. Where a correction affects an order you have placed, we will contact you before dispatch and you may cancel for a full refund.
B4. Intellectual property
We own or are licensed to use all intellectual property rights in the site and its content, including text, layout, graphics, logos and the Bramwell Views name. These are protected by copyright, trade mark and other laws of the United Kingdom and internationally.
You may print or download extracts for your own personal use. You must not modify copies, use any illustration or photograph separately from the accompanying text, or use any part of the site's content for commercial purposes without our written permission.
Product photography and technical illustrations may be supplied to us by our manufacturers and remain their property.
B5. Reviews and submissions
If you submit a review, comment, question or other content to the site, you confirm that it is your own, that it is accurate, and that it does not infringe anyone else's rights or break any law.
You grant us a non-exclusive, royalty-free licence to use, reproduce and publish that content in connection with our business. We may edit or remove content that is unlawful, misleading, offensive or otherwise inappropriate, and we are not obliged to publish anything you send us.

Links to other websites are provided for information. We have no control over their content and accept no responsibility for them, or for any loss arising from your use of them.
You may link to our home page provided you do so fairly and legally, and in a way that does not suggest any association or endorsement that does not exist. We may withdraw linking permission at any time.

Nothing in these terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your legal rights in relation to goods you buy from us.
Subject to that, we exclude all implied conditions, warranties and other terms that may apply to the site and its content, and we are not liable for any loss or damage that is not a foreseeable result of our breach.
We supply goods for domestic and private use. We are not liable for loss of profit, loss of business, business interruption or loss of business opportunity.
We are not liable for loss or damage caused by a virus or other technologically harmful material that infects your equipment through your use of the site or anything you download from it. You should use your own virus protection.
